Brighton Announces ICON Energy Class Action Settlement 

 

The class action lawsuit brought by the Town of Brighton on behalf of over 10,000 households and small businesses that were part of the Brighton Sustainable Energy Community Choice Aggregation (CCA) program has been settled. Nearly $1 million is being paid to Brighton residents on behalf of ICON Energy, d/b/a Source Power, the Town’s energy supplier for the CCA program, who defaulted on its clean electricity supply contract with Brighton in 2022. Brighton’s attorney fees will also be paid by ICON under the terms of the settlement.

 

Brighton Supervisor William Moehle announced the settlement and the payment terms, saying, “We are pleased that Brighton customers of the CCA and the Town of Brighton itself will be made whole by the terms of this settlement. Town residents had saved over $1.5 million compared to the retail price of sustainable electricity during the first 18 months of the two-year contract, and would have saved an additional amount of approximately $1 million more during the final six months, had ICON not defaulted. This settlement will reimburse them for those lost savings.

 

Approximately 7700 customers remained as participants through the entire program, and they will receive $40 plus an additional amount based on their actual electricity usage, ranging from $40 to as much as $800, although most customers will receive between $70 and $200. Customers who left the program before ICON defaulted will receive $40. Payments have been mailed to customers by the Town’s Class Action Administrator, Continental Datalogix,   based on the customer addresses on record, and will be arriving shortly.  Any amounts returned to sender or not cashed will revert to the Town in six months and will be applied to future renewable energy initiatives, according to the terms of the Settlement Agreement.  Homeowners with questions or who were part of the program, but do not receive checks can email questions@brightoniconsettlement.com or call Continental Datalogix at (833) 215-9289.
